Our Commitment to Your Privacy

Spearmint Energy® respects the privacy of everyone who visits www.spearmintenergy.com (the “Site”). This Privacy Policy explains what information we collect when you use the Site, how we use and protect that information, and the choices available to you. It applies solely to information collected through this Site and does not govern data collected through other means, such as offline interactions, employment records, or vendor relationships.

 

This Policy is maintained in compliance with applicable U.S. federal law, including the Federal Trade Commission Act (15 U.S.C. § 45) and the Children’s Online Privacy Protection Act (COPPA, 15 U.S.C. §§ 6501–6506), along with other federal requirements relevant to Spearmint Energy®’s operations. By using the Site, you agree to the terms of this Policy.

We collect two categories of information through the Site: information you actively provide to us, and information collected automatically as you browse.

 

Information You Provide Directly

Certain features of the Site invite you to share information with us voluntarily. This occurs when you:

    • Submit a contact or inquiry form: we collect your name, email address, phone number (if provided), employer or organization, and the content of your message;
    • Apply for an open position through our careers section: we collect your name, contact details, resume, cover letter, work history, educational background, and any other information you include in your application;

 

You are never required to provide personal information simply to browse the Site. Providing information through forms is voluntary, though some fields may be necessary for us to respond to your request.

 

Information Collected Automatically

When you visit the Site, certain technical and usage data is collected automatically through cookies and similar technologies. This may include:

This add-on prevents Google Analytics from receiving data about your visits. Spearmint Energy® does not have access to the opt-out mechanism directly and is not responsible for its operation.

3. How We Use Your Information

Spearmint Energy® uses the information collected through the Site for the following purposes, each of which is consistent with the reason the information was provided:

    • Responding to inquiries: To review and respond to messages submitted through contact forms, including routing requests to the appropriate team.
    • Recruiting and hiring: To evaluate job applications, communicate with applicants about open positions, and administer the hiring process. Application data is used solely for recruitment purposes.
    • Site operation and improvement: To monitor Site performance, diagnose technical issues, analyze usage patterns, and make improvements to content, structure, and functionality.
    • Security: To detect, investigate, and respond to unauthorized access attempts, fraudulent activity, or other threats to the integrity of the Site or our systems.
    • Legal and regulatory compliance: To fulfill obligations under applicable federal law, respond to lawful government or regulatory requests, enforce our Terms of Use, and protect the rights and safety of Spearmint Energy® and others.

 

We do not use personal information collected through the Site for targeted advertising or behavioral marketing, and we do not sell personal information to third parties.

4. Legal Basis and Regulatory Alignments

Federal Trade Commission Act (FTC Act)

Under Section 5 of the FTC Act, Spearmint Energy® is prohibited from engaging in unfair or deceptive acts or practices in connection with the collection or use of consumer data. This Policy is designed to accurately and completely describe our data practices so that your decision to interact with the Site is fully informed. We do not make material misrepresentations about privacy, and our actual practices conform to the disclosures made here.

 

Children’s Online Privacy Protection Act (COPPA)

The Site is a corporate information resource directed at business professionals, industry participants, and the general public. It is not directed at children under the age of 13, and we do not knowingly solicit or collect personal information from children under 13. If we become aware that a child under 13 has submitted personal information through the Site, we will delete it promptly. If you have reason to believe a child has provided us with personal information, please contact us at the address in Section 11.

5. How We Share Your Information

We do not sell, rent, or trade personal information collected through the Site. We may share your information in the following limited circumstances:

    • Service Providers: We engage third-party vendors to assist with Site hosting, analytics, recruiting platforms, and systems support. These providers access personal information only as needed to perform services on our behalf and are contractually required to protect it and use it solely for authorized purposes. Google LLC processes analytics data on our behalf pursuant to Google’s data processing terms.
    • Professional Advisors: We may share information with legal counsel, accountants, auditors, or other professional advisors where necessary for legitimate business or legal purposes, subject to appropriate confidentiality obligations.
    • Regulatory and Legal Compliance: We may disclose information when required by applicable law, court order, regulatory directive, or lawful request from a government authority. We may also disclose information where we believe disclosure is necessary to protect the rights, property, or safety of Spearmint Energy®, our personnel, or the public.
    • Corporate Transactions: In the event of a merger, acquisition, restructuring, asset sale, or similar transaction involving Spearmint Energy®, personal information held by us may be transferred to the successor entity as part of that transaction, subject to equivalent privacy protections.
    • Affiliate Entities: We may share information with subsidiaries or affiliated entities of Spearmint Energy® for purposes consistent with this Policy.

 

In all cases, we limit the information shared to what is reasonably necessary for the stated purpose.

6. Data Retention

We retain personal information only for as long as necessary to fulfill the purpose for which it was collected, or as required by applicable law or legitimate business need. Our general retention practices are as follows:

    • Contact form inquiries: Retained for a reasonable period sufficient to address your inquiry and any related follow-up, typically not exceeding two (2) years unless an ongoing business relationship warrants longer retention.
    • Job applications: Retained for the duration of the relevant hiring process and for a period thereafter sufficient to support any legal obligations or disputes that may arise in connection with the recruitment process, generally not exceeding three (3) years from the date of application.
    • Analytics data: Aggregated and anonymized usage data collected through Google Analytics is retained in accordance with Google’s data retention policies as configured by Spearmint Energy®. Non-aggregated session-level data is not retained by Spearmint Energy® beyond what Google processes on our behalf.
    • Legal holds: Where information is subject to a legal hold, litigation, regulatory inquiry, or preservation obligation, it will be retained for the duration of that obligation regardless of the standard retention period.

 

When personal information is no longer needed, we apply appropriate deletion, anonymization, or destruction procedures consistent with the sensitivity of the information.

7. Data Security

Spearmint Energy® implements and maintains administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or destruction. Our security practices include encrypted data transmission (TLS/SSL), role-based access controls, security assessments, and periodic review of our security posture consistent with industry standards.

 

No information system can be guaranteed to be completely secure, and we cannot warrant that information transmitted through the internet will always be protected from interception or unauthorized access. In the event of a data security incident that triggers notification obligations under applicable federal law or guidance, we will notify affected individuals and relevant authorities as required.

 

You are responsible for maintaining the confidentiality of any credentials or access information you use in connection with the Site and for promptly notifying us of any suspected unauthorized activity.

8. Links to Third-Party Websites

The Site may contain links to external websites operated by third parties. This Privacy Policy does not apply to those websites. Spearmint Energy® has no control over the privacy practices or content of linked sites and is not responsible for how they collect, use, or protect your information. We encourage you to review the privacy policy of any third-party site you visit before submitting personal information to it.

9. Do Not Track Signals

Some browsers offer a “Do Not Track” (DNT) feature that signals to websites that you prefer not to be tracked across sites. There is currently no universally accepted standard for how websites should respond to DNT signals. The Site does not respond to DNT signals at this time. If a standard is adopted and we are required to honor it, we will update this Policy accordingly.

10. Changes to This Privacy Policy

Spearmint Energy® reserves the right to update or modify this Privacy Policy at any time. When we make changes, the revised Policy will be posted to this page with an updated effective date. Material changes will be identified clearly so that returning visitors can easily identify what has changed. Your continued use of the Site after any update constitutes your acceptance of the revised Policy. We encourage you to review this page periodically.
